Thank you Chairperson,

I’m giving this statement on behalf of the Sami Parliament in Norway.

Chairperson,

The Sami Parliament will address the first study made by the Expert Mechanism regarding the Rights of Indigenous Peoples to education. Again we would like to express our gratitude for the Expert Mechanism making its first study on such an important issue as education is for indigenous peoples.

The study provides many important advices with directly concern for the Sami people living in Norway.

The Sami Parliament will make some remarks concerning the Expert Mechanism’s on the Advice No 1 2009 at its point 12 says, and I quote:

States are obliged, collectively and individually, to make quality education available to all indigenous peoples, accessible without any prohibited form of discrimination, acceptable in the light of international human rights standards, and adaptable to the circumstances and in the best interest of indigenous peoples.(...)”, end of quote.

Chairperson,

Adequate financial recourses are crucial for the fulfilment of education for indigenous peoples after article 14 in the Declaration and after article 13 of the Covenant on Economic, Social and Cultural Rights, and international human law establish obligations for governments to give necessary financial recourses to indigenous peoples for the full realization of their rights, as stated under article 39 in the Declaration and article 2 in the Covenant on Economic, Social and Cultural Rights.  

States are obliged to implement the right to education to the maximum of its available recourses, with the aim of progressively achieving the full realization of the right to education.

Therefore we encourage, and especially those states considered to be resourceful, within short time to take all necessary steps to make national legislation and policies in accordance with international human right standards, in order to implement the Expert Mechanism’s previous set Advices No 1 on the right of education for indigenous peoples from 2009.
